Customs
To get items (including "in-kind" investments in Ukraine) through customs, the following documents must be submitted to the customs house which functions within the zone of the recipient:
  1. Statutory documents of an enterprise with foreign investments. These documents state the formation of a statutory fund with qualified foreign investments, determined in correspondence to the Law of Ukraine "On Foreign Investments";
  2. Information on state registration of the foreign investment into Ukraine including the amount of contribution by a foreign investor to the statutory fund of the enterprise with foreign investments (issued by the local Department of Foreign Economic Relations);
  3. Customs declaration;
  4. Cargo attachments (account invoice, specifications, transport documentation);
  5. Permission of a related state body if, according to current legislation, the imported item falls under its control.
Prior to submitting the above documents, the following requirements must be met:
  • accreditation of a legal business entity within the zone of customhouse function;
  • existence of a contract - an agreement upon economic relations;
  • all necessary cargo attachments (product and transport way-bill, invoice, specifications);
  • permission documents (permits and licences) as required by current law;
  • certificate of product quality and origin;
  • payment of customs fees, duties, taxes, etc. as required by current law.
To clear customs for foreign investments into Ukraine, a foreign investor or an authorized person must register information on the foreign investment at the local body of the Ministry of Foreign Economic Relations and Trade.
